If the CDC recommends it, Joe Biden will appeal a court decision that declared his face covering mandate for those riding on federal flights unconstitutional.

This week, a federal judge in the Middle District of Florida ruled that the Biden administration’s airport mask requirement was unconstitutional and that the CDC had overstepped its bounds.
The Department of Justice and the Centers for Disease Control and Prevention (CDC) have announced their intention to appeal, subject to CDC’s determination that the order is still required for public health.
“The Department continues to believe that the masking order in the transportation corridor is a lawful use of CDC’s authority to protect public health,” according to the DOJ. “That is an important power that the Department will continue to seek to maintain.”
“If CDC decides that a mandatory mask order is still needed for the public’s health after its analysis, the Department of Justice will appeal the court’s decision.”
The DOJ’s statement follows one day after the department declined to comment on any future efforts to appeal the court decision.
Following the decision, the White House has given a range of conflicting statements. Although White House Press Secretary Jen Psaki said she was “disappointed,” Biden stated this week that it is “up to passengers to choose whether or not they wear masks on planes.”
The White House, on the other hand, this week, requested that reporters who travel with Biden aboard Air Force One wear their masks. “Masking will be necessary during this trip in accordance to CDC instructions,” an aide informed journalists.
The CDC announced an extension to the federal transportation mask requirement on April 13, before the court’s decision. It is uncertain whether CDC officials will advocate for Biden’s appeal at this time.
