The Department of Justice (DOJ) filed a lawsuit against Texas over redistricting, claiming the newly approved maps discriminate against voters. Meanwhile, Texas retaliated, calling the lawsuit Biden’s attempt to manipulate Texas voters.

Merrick Garland sued Texas for latest redistricting effort

Claiming the Texas redistricting maps violate the Voting Rights Act, Merrick Garland said new maps are against the black and Latino voters of the state.

He further asserted the maps are intentionally manipulated for orchestrating election results at both the state and the federal levels.

The Attorney General noted the Texas legislature denied accepting the rising minorities of the state, which prompted them to adjust two new congressional seats in areas with Anglo-American majorities.

After the 2020 census, Texas was given two extra House seats, due to the upsurge of the state’s population, which increased Texas’s congressional tally to 38.

The DOJ added these two seats were due to the increase in the population of black voters; however, both of these seats have been assigned to districts having white majorities.

Vanita Gupta, the Associate Attorney General of the United States, asserted Texas has also tried in the past to curb the voting rights of minorities. She added the court repeatedly found that Texas violated the Voting Rights Act, so it should once again overturn the maps.

The DOJ is trying to invoke Section 2 of the Voting Rights Act, which prohibits anyone from manipulating the voting process in a way that is driven by racism.

The section states electoral maps must provide everyone an equal opportunity to vote. Thus, any attempt to create racial-driven maps is discouraged.

Texas is hopeful of passing the court challenge against maps

Speaking against the measure, Ken Paxton, the Texas attorney general, said the Biden administration wants to sway democracy by using these sorts of lawsuits. Likewise, he added these lawsuits are directed to control state voters from the federal level.

He expressed optimism that the effort of the Texas legislature in redrawing maps will stay intact, and the court will not overturn them. Democrats have often cried fouls against Republicans, claiming the GOP is involved in passing voter suppression bills.

However, Republicans are unmoved by their comments and continue pushing Democrats out of the 2022 midterm elections using various tactics, of which redistricting is the top one.

The Biden administration has repeatedly sued Texas, the latest example of which was seen recently when the DOJ filed a lawsuit against Texas’ abortion law.

Similarly, it also tried to overturn the Texas voting reforms bill in November which suggested the bill, named SB 1, denied people the right to vote.

However, the bill was only intended to limit the mail-in voting, alongside restricting too much leeway given for early voting. The bill was signed into law in September by Greg Abbott, the Texas governor.

It is pertinent to note here the Biden administration has not been successful against Texas in any court, until now.
